Rights of Light

Rights of Light Consulting advice developers, architects and surveyors on daylight and sunlight matters to ensure that new buildings meet planning requirements and do not infringe legal rights to light. We also assist neighbours to defend their entitlement to daylight and sunlight when these become threatened by development.

Your right to light is protected in England and Wales under common law. If a new building limits the amount of light coming in through a window and the level of light inside falls below the accepted level, then this constitutes an obstruction. Unless you waive your rights you are entitled to take legal action against your neighbour.

As highly experienced advisors, Buicon Ltd can help to ensure that development plans meet the latest planning requirements and do not infringe upon neighbouring owners’ legal rights to light. Buicon Ltd can also provide assistance to neighbouring owners, helping to defend their entitlement to daylight and sunlight should these become threatened by future developments.
